Welcome to Swan Song Journey. By accessing or using my website www.swansongjourney.com.au and services, you agree to comply with these Terms & Conditions ("Terms"). These Terms outline the rights and obligations of both users and my business.
If you do not agree with these Terms, please do not use my website or services.
2. Website Use & Access
You agree to use my website for lawful purposes only and must not:
● Engage in any fraudulent, abusive, or unlawful activity.
● Use automated systems (e.g., bots, scrapers) to extract website content without permission.
● Infringe on intellectual property rights.
I reserve the right to restrict or terminate access to my website if these Terms are violated.
3. Intellectual Property
All content on this website, including text, graphics, logos, images, and software, is my property or licensed to me. You may not reproduce, distribute, or modify content without written permission.
Trademarks, service marks, and business names displayed on the website remain my property or that of respective owners.
4. Pricing & Payments
● All prices are in Australian Dollars (AUD)
● I reserve the right to update pricing at any time.
● Invoiced payment of deposit (sent to client’s email) must be made in full before first service delivery and all invoiced payments (sent to client’s email) thereafter must be paid in full within 48 hours after service delivery. Receipts will be sent to client’s email after payment made.
● I use secure third-party payment providers (Square and PayPal).
For Non-Payment: If the Client fails to pay within seven (7) days of a payment due date, the Service Provider may suspend services or terminate this Agreement.
Upon termination, the Service Provider shall deliver all completed work to the Client, and the Client shall pay for any work completed up to the termination date.
By purchasing my services, you agree to these payment terms.
5. Consumer Guarantees & Refund Policy
I comply with Australian Consumer Law (ACL), ensuring consumer rights to refunds, replacements, or repairs under specific circumstances.
5.1. Consumer Guarantees (Your Rights under ACL)
As per ACL, you are entitled to a refund, repair, or replacement if:
● The product or service is faulty, unsafe, or not as described.
● The service fails to meet a reasonable level of care and skill.
● The product does not function as expected or intended.
I am not required to provide a refund if you:
● Change your mind after purchase.
● Misuse the product or service in a way that caused the issue.
● Fail to follow service instructions or advice.
5.2. Service Refunds
Refunds will only be granted under the ACL if:
● The service has a major failure (e.g., cannot be performed as advertised).
● The service was not delivered at all within an agreed timeframe.
I may offer partial refunds or re-performance of services at my discretion for minor issues.

6. Cancellations & Rescheduling
Client Cancellations:
Cancellations must be made at least 24 hours in advance to receive a refund of the $40 deposit.
If you cancel with less than 24 hours’ notice, the deposit will be forfeited to cover preparation and scheduling costs.
Ongoing Service Reschedules:
Please provide at least 24 hours’ notice to reschedule an ongoing service.
If less than 24 hours’ notice is given, immediate rescheduling may not be possible due to limited availability.
I’ll do my best to offer the next suitable time.
My Cancellations:
If I need to cancel, I’ll provide at least 24 hours’ notice and reschedule your session at the earliest available opportunity.
7. Limitation of Liability
To the fullest extent permitted by law, I am not liable for:
● Indirect, incidental, or consequential damages arising from website use or service reliance.
● Third-party failures (e.g., payment providers, hosting platforms).
● Temporary unavailability of the website due to maintenance or system issues.
My total liability is limited to the cost of the service purchased.
8. Third-Party Links & Services
My website may contain links to third-party websites. I do not control or endorse external sites and are not responsible for their content or privacy practices.
9. Privacy & Data Protection
My Privacy Policy governs how I collect, use, and protect your personal information. By using my website, you consent to these privacy practices.
10. Amendments & Updates
I reserve the right to amend these Terms at any time. Updates will be effective immediately upon posting on my website.
Continued use of my website or services constitutes acceptance of the revised Terms.
11. Dispute Resolution

Disputes will be resolved through good-faith negotiations. If unresolved, either party may escalate through:
Mediation via an independent body (e.g., Australian Small Business and Family Enterprise Ombudsman).
Legal action in a Queensland court, if necessary.
12. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be handled in Queensland courts.
